Terms of Service

1. Contract overview

Grow As You Go ("GAYG") is offered by Grow As You Go ("we"). By creating an account, starting a subscription, or using any part of the GAYG app, site, API, or offline programming, you agree to these Terms and to our Privacy Policy.

Who may use GAYG

• You must be at least 18, or 13 with verified parent or guardian consent under our Age & Parental Consent Policy.
• You promise all registration information is accurate and kept updated.

2. Accounts and security

You are responsible for keeping your login secure and for all activity under your account. Notify us quickly at security@growasyougo.love if you suspect unauthorized access. We may require identity checks to protect the community.

3. Subscriptions and paid plans

We provide both free and paid access tiers. Paid plans auto-renew monthly unless cancelled, as detailed in our Refund & Cancellation Policy. You authorize recurring charges until you cancel. Prices may change with advance notice. Free trials convert to paid unless cancelled before the trial ends.

4. License to use GAYG

Subject to these Terms, GAYG grants you a limited, revocable, non-transferable license to access and use the service for personal, non-commercial growth and training. You may not resell access, copy significant portions of the platform, or develop competing datasets using our content.

5. Acceptable use and community behavior

Use GAYG in line with our Acceptable Use Policy and Community Guidelines. You agree not to:

• Break or bypass security controls.
• Upload malware, spam, or deceptive content.
• Promote self-harm, hate, or violence.
• Misrepresent your identity, credentials, or affiliations. We may suspend or end accounts that put others at risk or violate these rules.

6. Intellectual property

All GAYG materials, including workouts, prompts, text, graphics, audio, and software, belong to us or our licensors. You receive no ownership interest. Our marks, including "Grow As You Go" and "GAYG," may not be used without written consent.

7. User-generated content

You retain ownership of content you upload or create. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publicly display, and distribute your content as needed to operate and improve GAYG, to moderate per our Content Safety & Moderation Policy, and to promote community features. You confirm you have the right to grant this license and that your content does not infringe others.

Feedback

If you send feedback or suggestions, we may use them without restriction or payment to you.

8. Termination

We may suspend or terminate access at any time for violations, risk to others, legal requirements, or inactivity over 12 months. You may close your account at any time via account settings. Sections that by nature should survive termination will continue, including IP rights, disclaimers, indemnity, arbitration, and limitation of liability.

9. Disclaimers and risk

GAYG provides personal growth and wellness information. We are not a healthcare provider, and GAYG is not HIPAA-covered. Programs may not suit every person. Use your judgment and consult qualified professionals. Services are provided "as is" without warranties of accuracy, completeness, or availability.

10. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for all claims in any month will not exceed the fees you paid for that month. Some jurisdictions do not allow limitations; in those cases the limitation applies to the fullest extent permitted.

11. Indemnity

You will defend and indemnify us and our team from claims, damages, and costs (including reasonable attorney fees) arising from your misuse of GAYG, breach of these Terms, or violation of law or third-party rights.

12. Governing law and venue

These Terms are governed by Colorado law, without regard to conflict-of-laws principles. The exclusive venue for any court action permitted below is state or federal courts located in Denver County, Colorado, and you consent to personal jurisdiction there.

13. Arbitration and class action waiver

Most disputes can be resolved by contacting support. If not, any dispute, claim, or controversy arising out of or relating to these Terms or your use of GAYG will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will occur in Denver, Colorado, before a single arbitrator. Either party may seek relief in small-claims court for qualifying matters. You may opt out of arbitration by sending written notice to legal@growasyougo.love within 30 days of first accepting these Terms. Proceedings will be confidential. You and we waive any right to bring claims as a class, collective, consolidated, or representative action.

14. Changes we may make

We may update these Terms to reflect new features, legal requirements, or community feedback. We will post the revised Terms with an updated date and, when material, provide notice through the app or email. Continuing to use GAYG after changes take effect means you accept the revised Terms.
